Understanding the Hierarchy of the Criminal courts in Indonesia

March 08, 2025 posted by Steve Brownstein

The Indonesian criminal court hierarchy, within the broader Indonesian judicial system, primarily revolves around the "General Courts" (Peradilan Umum). Here's a breakdown:

District Courts (Pengadilan Negeri):
These are the courts of first instance. They handle the initial trials for most criminal cases within their respective city or regency.
They have original jurisdiction.

High Courts (Pengadilan Tinggi):
These are the appellate courts. They review decisions made by the District Courts.
They have appellate jurisdiction at the provincial level.

Supreme Court (Mahkamah Agung):
This is the highest court in Indonesia.
It serves as the final court of appeal for all cases, including criminal cases, from the lower courts.
It also has the ability to conduct judicial review on regulations.

Key points to remember:

Indonesia's judicial system also includes other specialized courts, such as Religious Courts, Military Courts, and State Administrative Courts, which handle specific types of cases.
The constitutional court (Mahkamah Konstitusi) is also a very important part of the judicial system, but its focus is on constitutional matters, and not the general criminal court system.

The general criminal court system, the one that deals with most criminal cases, flows from the district courts, to the high courts, and then to the supreme court.
